PAYMENT
Payment is by cheques made payable to PC Initiative Ltd, allowing
7 days to clear. PC Initiative cannot guarantee that
a service will be provided until after any received cheques have been
cleared.
All payments must be in UK sterling. |

DOMAIN NAME
REGISTRATION
PC Initiative will not process any registration applications until
full registration fees have been received and funds cleared. Payment
of registration fees does not imply acceptance. While PC Initiative
will make reasonable endeavours to achieve a successful registration
and keep the Customer notified of the progress of the registration
application, where it transpires that a domain applied for is unavailable,
delayed, declined or for any reason the registration is cancelled
by any authority or if any error or technical fault by any party results
in the loss of the domain then the Customer may be reimbursed in full
the payment made in respect of the domain but shall not be entitled
to any further compensation.
The registration of a domain cannot be treated as having been successful
until the name of the Customer appears in the registration authority's
database. The Customer is strongly advised not to take any action
in respect of a requested domain until they have either received a
notification from PC Initiative or they have verified
registration via the domain name search facility provided by PC
Initiative.
Registration is for two years unless otherwise stated. Although PC
Initiative will make every effort to remind the Customer to renew
the registration, it is ultimately the Customers responsibility to
ensure this happens, and they are therefore requested to make a note
of the application date.
Domains may be transferred to or from PC Initiative upon written instruction
from the Customer. Transfers may incur a small administrative charge
payable by the Customer. |

WEB DESIGN AND
CONSULTANCY
Design services require an advance payment of forty percent of the
proposed projects total. The remaining sixty percent will be due within
7 days of completion of the work. All fees quoted are subject to review
and adjustment by PC Initiative dependant on actual work
undertaken.
Payment of an invoice is within 7 days of the invoice date. If the
Customer fails to pay any invoice which is due and payable under these
terms and conditions, PC Initiative reserves the right
to charge interest at 3 percent per day above the Lloyds Bank plc
base rate on payments overdue.
Advance payments and/or interest charges may, with prior written agreement
with PC Initiative, be reduced or dispensed with.
All invoices unpaid thirty days after the date of the invoice will
be considered in default. PC Initiative will, at their
discretion, remove permanently or suspend any design work. Removal
or suspension of work does not relieve the Customer of the obligation
to pay any outstanding fees.
All content, photos, graphics and other files and data being provided
by the Customer, must be supplied to PC Initiative prior
to the commencement date of the project. Any delay may cause increased
costs and / or the possible extension of the completion deadline.
Images should be supplied in appropriate format (GIF / JPG / PNG),
and each file should typically be under 20kb. Additional charges may
be imposed for all reworking or reformatting of images. Although every
reasonable attempt shall be made by PC Initiative to
ensure the safety of items sent for processing, PC Initiative
shall not be responsible for any loss or damage to items whilst in
our possession or in the course of production or in transit which
does not result directly from our negligence. Please do not send any
irreplaceable or original materials.
The Customer must own copyright, or have reproduction rights, of all
artwork, trade names, photographs and other materials supplied to
PC Initiative for the inclusion on the Customers web
site. The Customer shall indemnify PC Initiative against
any liabilities due to breach of copyright caused by any supplied
material. PC Initiative reserves the right to
refuse publication of any content it considers obscene or morally
unsuitable or is seen to breach copyrights, libellous, defamatory
or illegal. Should such a submission occur the Customer will be advised
which content was deemed unsuitable. If the Customer can show good
reason to use the "unsuitable" content it's inclusion may be considered.
PC Initiative will endeavour to ensure that errors
and omissions do not occur in the Customers web site. However, PC
Initiative will at no time be responsible for accidentally
including erroneous information aside from correcting the error. If
the Customer discovers an error on their site, PC Initiative
will immediately correct the error as soon as we are notified. No
charge will be levied for corrections.
A reference link will be inserted on the Customers page in either
small type or by a small graphic. If a graphic is used, it will be
designed to fit in with the overall site design. The Customer agrees
that PC Initiative may use the Customers name and web
site for the purposes of promoting PC Initiative and
it's services. |

WEB SITE HOSTING
Web hosting accounts are to be used by the primary customer only.
Customers are not permitted to resell, store or give away web hosting
services of their web site to other parties. Web hosting services
are defined as allowing a separate, third party to host content on
the customer's web site. Exceptions to this include ad banners, classified
ads and personal ads.
The Customer shall not use the web hosting account to publish, link
to, post or otherwise transmit any material that is defamatory, pornographic,
obscene, indecent, abusive or which is in any other way unlawful.
Neither will they knowingly transmit computer viruses or other destructive
or contaminating code or program, unsolicited promotional e-mail or
other bulk e-mail (spam), any material that infringes the copyright
or trade mark rights of any party.
The Customer will ensure that any material provided or posted to a
PC Initiative web hosting account, is "server-ready"
and which requires no additional manipulation on the part of PC
Initiative. Whilst PC Initiative may endeavour
to assist the Customer on a "good-will" basis, it is not the responsibility
of PC Initiative to provide knowledge, support or assistance
in relation to the Customers web site hosted on a PC Initiative
server unless otherwise agreed in writing with PC Initiative.
The Customer acknowledges and accepts that it bears sole responsibility,
legal and otherwise, for the content of all material appearing on
its web site. PC Initiative reserves the right to refuse
service and / or access to its servers to anyone.
Data stored on a PC Initiative web hosting account is
not guaranteed to be backed up. The Customer is therefore recommended
to keep an independent backup of all / any important data.
The contract period of a web hosting account is for 12 months. All
fees must be paid for in advance. One month prior to the contract
end date a renewal invoice will be sent to the Customer, thereafter
the contract and all services may be renewed for a further 12 months
subject to the payment by the Customer of the renewal fees. The Customer
may terminate their contract at any time by written request giving
30 days notice. PC Initiative reserves the right
to cancel any services at any time. In this event the Customer will
be entitled to a pro rata refund based upon the remaining period of
their contract. If the Customer contravenes any of the terms and conditions
a refund will not be issued in the event of a cancellation. |

E-MAIL SERVICES
(including e-mail forwarding)
The Customer will ensure it will not use e-mail services provided
by PC Initiative that breaches or contravenes any terms
and conditions stipulated by PC Initiative.
The Customer acknowledges and agrees that PC Initiative
is not responsible for the security of the contents of e-mails sent
or received by the customer. PC Initiative will make
every effort to ensure that messages are routed accurately and promptly
but do not accept any liability for non-receipt, non-delivery or misrouting
of e-mail or any other failure of the e-mail system. |

UNLIMITED USE
POLICY PC Initiative offers an unlimited
use policy by maintaining very large ratios of bandwidth per customer.
In rare cases, PC Initiative may find a Customer to be
using server resources to such an extent that he or she may jeopardise
server performance and resources for other customers. In such instances,
PC Initiative reserves the right to suspend that Customers
site immediately. This is only implemented in extreme circumstances
and is intended to prevent the misuse of our servers. Customers may
be offered an option whereby PC Initiative continues
hosting the website for an additional fee. |

DATA PROTECTION
PC Initiative will comply with the relevant English
Data Protection laws. Any personal details provided to PC Initiative
will not be disclosed to third parties without the Customers consent. |

INDEMNIFICATION
The Customer shall defend, indemnify, save and hold PC Initiative
harmless from and against any and all costs, claims, losses, damages,
demands or liabilities (whether civil or criminal) and expenses (including,
but not limited to, legal fees) sustained or incurred by PC
Initiative, its agents, officers, employees, sub-contractors
and customers, that may arise or result from any service provided
or performed or agreed to be performed or any product distributed,
offered or sold by a customer, its agents, employees or assigns. |

DISCLAIMER
PC Initiative will not be responsible for any damages
you may suffer. PC Initiative makes no warranties of
any kind, expressed or implied for services we provide. PC Initiative
disclaims any warranty or merchantability for a particular purpose.
This includes loss of data resulting from delays, non-deliveries,
wrong delivery, and any and all service interruptions caused by routine
maintenance, repairs, reconfigurations or upgrades or where there
are circumstances beyond the control of PC Initiative
or its employees. PC Initiative reserve the
right to utilise a range of third party Internet services providers
and related services as part of the services provided under these
terms and conditions. PC Initiative will not be responsible
for any loss or damages caused by any failure of a third party provider.
PC Initiative reserves the right to revise its policies
at any time. These terms and conditions are governed by English law
and shall be subject to the exclusive jurisdiction of the English
